Legal issues of which to be aware when selling Homes in Spain.
1. Legal & Administrative:
- Property Registry: We will help you ensure your property is properly registered and up-to-date. If not it is no problem for us to arrange it.
- Title Deeds: Have all necessary documents readily available for potential buyers, including the title deed (Escritura).
- Taxes: Understand the applicable taxes, including the “Plusvalía” tax, which is calculated on the capital gain from the sale. Sometimes this can vary on the Costa del Sol and Costa Blanca.
2. Transaction & Closing:
- Pre-Contract (Arras): Understanding the pre-contract agreement and its implications.
- Completion (Escritura Publica): Ensuring the final deed is correctly drafted and signed before transferring ownership.
- Payment Process: Agreeing upon a secure and transparent payment method for the transaction.
3. Other Considerations:
- Property Condition: If needed we can help you to prepare your property for sale by making necessary repairs, presenting it in its best possible light. Even just a few “touch-ups” can make a big difference.
- Documentation: Gathering all relevant documents, including building permits, utility bills, and tax records. This is all helpful to potential buyers.
4. Marketing & Pricing:
- Market Research: We can help you to research current market conditions, comparable properties, and appropriate pricing strategies. You can compare many on our site.
- Marketing Efforts: We use several marketing channels to reach potential buyers, including online platforms, real estate partners, and local advertising.
- Negotiation: Be prepared to negotiate with potential buyers to reach a mutually agreeable price.
